HELP! Sunroof drain recall and damage not being covered by VW!

Hi.

So I've finally had the issue with my drains. I now have mold under my carpet, headliner, etc.
The class action settlement covers my vehicle. However, I only learned about this yesterday, and I never ever received paperwork in the mail.

The dealer said to call VWOA because they can't overrule a transaction like that. I called VWOA and they directed me to the water ingress settlement, who told me I can't submit a claim after 2012. I have audio proof that they didn't have an address on file until I called yesterday. I have yet to call VWOA back and bitch. I do have mold allergies and asthma so this is bad. I keep up with my vehicle but this is an issue I wasn't really aware of until I started to notice how muggy it was inside my vehicle after rain or direct sun.

Please tell me what I can do. Lawyer up?

No. Your car is outside the recall time length. It is your responsibility to register your address with VW when you buy the car. We bought our VW used, registered it immediately, and had no problem with getting notices.

Either pay for the work, or sell the car if your medical condition warrants it. Personally, I would choose the latter if it were affecting my health.

I did register upon purchase. They still didn't have an address on file.
I hate to say it, but if your health is at stake, you may need to cut your losses and buy another car. When you do buy another vehicle, I'd not buy any vehicle with a sunroof or a convertible. The risk that they're going to eventually leak is quite a bit higher than a vehicle without them.

I know a co-worker who's had their relatively new VW Tiguan in for service several times due to their sunroof leaking. I think in their case it was the drain tubes which were not working correctly. Luckily for them, it was still under warranty when it happened.

Selling this car and buying a new one isn't a financial decision I can make right now.

However, after being on the phone with VWOA for 20 mins, because I didn't have the title until this year (yay car payments!) the dealer I bought it from would have had the title/case claim mailed to them. So, I am currently waiting for a call back from the service manager of that dealership to see what they can do for me.
If you registered it, and the dealer had your info, they should be responsible for the service. Get the area rep involved. They may "goodwill" part or all of the work. Getting a lawyer involved will quickly cost more than your car is worth.

The lawyer is doing me a favor so we are judging if I have a case right now.

What would my area rep be? The dealer I bought it from can't do anything (Cadillac). The local dealer (vw) I was going to for parts and repairs didn't say anything to me and that would have been when the lawsuit happened. The caddy dealer said that, because the bank had the title, the bank would have gotten the notice and should have forwarded it to me. I'm located in Chicago now but I used to be in Southern NJ.
Ok, more clear now. If you bought from a CADILLAC dealer, it was YOUR responsibility to register the car with VW for warranty work. Everything I said in post #2 still applies.

If money is a real issue, using a lawyer will still result in you having to pay the lawyer even if VW agrees to fix the car.

One more angle to try would be to contact your car insurance company and see if something like this is covered, but I'm guessing it won't. If it is, you could get your insurance to pay for the repairs (minus your deductible) and have their lawyers go after VW, if there really is a case to be made against them.
If the Lawyer is doing her a favor and doing this work 'pro-bono' or what ever their legal term is for a "Free" consult and such. I'd at least use that resource to see what the options are. If the bank did get the notice about the notice, and you can prove it? Then you may have a claim against the bank for negligence (Good luck with proving it...Bankers love GREED and won't lift a finger unless it makes them a nice return)

I wish you where closer to our area. We have a lot of Beetles that come in/out of our pick and pull yards. Nail one within a few days? And you can usually score carpet and interior pieces pretty cheap and in good condition. (sorry, no seats--they can't sell air bags, so they knife seats) We also enjoy helping out other car owners trying to save a buck. (we spent 30 minutes with a gentleman removing the front nose section off a Chevy SUV in the yard--he has limited funds and hit a deer.)
